Terms and Conditions of Use of Hubviously

Welcome to Hubviously! These Terms and Conditions (“Terms”) govern your use of the Hubviously application (the “Service”), which is available on the HubSpot marketplace. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Service.

1. Acceptance of Terms

By accessing and using the Hubviously Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any other applicable laws and regulations. These Terms may be updated or revised from time to time, and your continued use of the Service constitutes acceptance of those changes.

2. Description of the Service

Hubviously is a SaaS application that automates internal linking for blogs hosted on HubSpot. The Service allows users to define keyword associations and automatically generate internal links between articles. It requires access to the user’s HubSpot CMS data to analyze blog content and implement link structures based on predefined configurations.

3. User Responsibilities

As a user of Hubviously, you agree to:

  • Use the Service in compliance with all applicable laws, including data protection regulations.

  • Ensure that any data processed through the Service is authorized and complies with your organization’s policies.

  • Safeguard your account credentials and restrict access to unauthorized users.

  • Notify us immediately if you suspect any unauthorized access to your account.

4. Access to HubSpot Data

Hubviously requires permission to access certain data within your HubSpot account. By using our Service, you grant us permission to access and use this data as necessary to provide the Service. You acknowledge that Hubviously will only access and use the data that you specifically select for the purpose of optimizing internal links.

5. Data Privacy, Security, and User Responsibility

5.1 Data Access and Processing

Hubviously accesses specific data from your HubSpot account solely to provide the Service. This data is only accessed in real-time when configuring and executing internal linking operations. Hubviously does not store, retain, or otherwise exploit any CRM or CMS data beyond what is necessary for link generation.

5.2 User Responsibility for Data Use

As a user of Hubviously, you are solely responsible for:

  • Ensuring that the data processed aligns with your company’s policies and legal obligations.

  • Verifying that links generated by the Service do not negatively impact SEO or user experience.

  • Maintaining the security of your HubSpot account to prevent unauthorized access.

Hubviously disclaims any responsibility for data loss, unauthorized access, or misuse of information resulting from user configurations.

6. Limitation of Liability

To the fullest extent permitted by law, Hubviously and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from:

  • Your use of or inability to use the Service.

  • Any unauthorized access to or use of your account or data.

  • Any disruption caused by third-party services, including HubSpot’s API changes.

7. Dependency on HubSpot Services

Hubviously relies on the HubSpot platform and its APIs. Any disruptions, limitations, or changes to HubSpot services that impact Hubviously are outside of our control. We will communicate known issues to users but disclaim liability for resulting losses.

8. Service Continuity and Limitations

8.1 Bugs and Technical Issues

While we strive to provide a stable service, Hubviously may encounter bugs or technical issues. We commit to addressing such issues promptly but do not guarantee uninterrupted service.

8.2 No Liability for Business Losses

Hubviously is provided “as is” and we do not accept liability for financial loss, business interruptions, or unintended SEO impacts due to the use of our Service.

9. Subscription and Payment Terms

9.1 Pricing and Fees

  • Subscription plans are detailed on the pricing page at hubviously.com/pricing.

  • Subscriptions renew automatically unless canceled before the end of the current billing cycle.

9.2 Payment Processing

Payments are processed securely via third-party payment providers. Hubviously does not store credit card information.

10. User License and Acceptable Use

10.1 License Grant

Users are granted a limited, non-exclusive, non-transferable license to use Hubviously. Users may not:

  • Reverse-engineer or modify the software.

  • Integrate the Service into unauthorized third-party applications.

  • Use the Service for fraudulent or unlawful purposes.

10.2 Acceptable Use Policy

Users agree not to use Hubviously for activities including:

  • Transmitting harmful or offensive content.

  • Interfering with the operation of the Service.

  • Violating any applicable laws or regulations.

11. User Data and Analytics

11.1 Data Ownership

Users retain ownership of their data. Hubviously processes this data only to deliver the Service.

11.2 Analytics and Usage Data

We may collect anonymized analytics data to improve the Service. This data will not be shared with third parties without user consent, except as required by law.
